Terms & Conditions of Service BackupIT

1. Scope of Services
BackupIT provides remote IT support, virus scanning, secure backups, proactive maintenance, and on‑site repairs when needed.
2. Monthly Plan

- Secure backups included – backups are stored on‑site using customer‑provided hardware (we can supply and set this up if required).
- On‑site visits if required – 45p per mile may be charged. Visits over 1 hours may incur additional fees.
- Discounts for 10+ PCs with the Remote + Backup plan – contact us for a tailored quote.
3. Payment Terms
- For all services, payment in full is required before any work begins.
- Invoices are issued immediately upon booking or request for service.
- Work will only be scheduled and commenced once cleared payment has been received.
- For ongoing monthly plans, payment for the upcoming month is due in advance and must be received before the start of the service period.
- We reserve the right to refuse or postpone service where payment has not been received in full.
4. Termination
- The customer may cancel at any time; however, no refunds will be issued for any unused portion of the current billing period.
- BackupIT reserves the right to cancel services at the end of the current billed month, with written notice provided to the customer.
5. Liability & Disclaimer
BackupIT’s liability is limited to the value of the last one‑month service fee. We are not liable for data loss due to events beyond our control. Clients must maintain adequate backups.
6. Client Responsibilities
You must provide a secure environment for remote access and ensure your hardware meets basic requirements. You’re also responsible for legal content and any data shared.
7. Support Availability
Remote and scheduled maintenance times are flexible. Emergency on‑site services are subject to availability and may occur outside normal hours.
8. Changes to Terms
BackupIT may update these terms. We’ll notify clients and post updates on the website.
9. Dispute Resolution
Any disputes will be handled via informal negotiation, escalating to mediation if needed.

11. Limitation of Remote Access
The customer understands and accepts that granting remote access allows BackupIT technicians to view and control their system. We will take all reasonable precautions, but we cannot be held responsible for any pre‑existing issues, hardware faults, or software corruption that occur during or after the session, unless caused by proven negligence on our part.
12. Data Responsibility
While BackupIT will take care to avoid data loss, the customer is solely responsible for ensuring all important data is fully backed up prior to any service. We are not liable for any loss of data, files, or software.
13. Third‑Party Services & Licences
Where services involve third‑party software or licences, the customer is responsible for obtaining and maintaining the correct licences. BackupIT will not be liable for issues arising from unlicensed or unsupported software.
14. Fair Use of Unlimited Support
Where a plan includes “unlimited” support, this is subject to fair use and intended for normal business use.
Fair Usage Policy
BackupIT provides certain services, such as remote support, under an “unlimited” usage arrangement. This is intended for typical business use and to resolve genuine technical issues as they arise. Excessive, repetitive, or unreasonable requests that fall outside normal usage — such as repeated calls for the same issue, requests outside agreed service hours, or demands for unrelated work — may result in additional charges, service restrictions, or termination of the agreement. What constitutes “fair use” is determined at BackupIT’s reasonable discretion.
15. Home Service Plan
- The Home Service Plan is billed at £10 per month per household device, payable monthly in advance.
- Remote support sessions are unlimited but subject to fair usage as described in Section 14.
- Secure backups are included where the customer provides suitable storage media (external drive or NAS). BackupIT can supply and configure storage at additional cost.
- Home visits are available by appointment. 45p per mile travel costs may be charged, and visits over 1 hour may incur additional charges for travel and time.
- The service is for personal/home use only. It may not be resold or used for business networks.
- BackupIT is not liable for data loss where backups are not configured correctly or where the customer fails to provide working backup hardware.
16. Force Majeure
BackupIT will not be liable for delays or failure to provide services due to events beyond our reasonable control, including (but not limited to) power failures, internet outages, supplier failures, extreme weather, or other circumstances outside our control.
